Australian Heritage Commission: An overview
The commission was an independent statutory authority established under the Australian Heritage Commission Act 1975. This Act was abolished when the new heritage legislation came into effect on 1 January 2004. The Minister responsible for the commission between 1 July and 31 December 2003 was the Minister for the Environment and Heritage, the Hon Dr David Kemp MP. The Minister gave no statutory directions to the chairman or commissioners during that time.
Corporate governance
The last meeting of the commission was held on 12 September 2003. The Australian Heritage Commission had established five sub-committees to examine in detail nominations for entries in the Register, to formulate recommendations to the Australian Heritage Commission and to advise the Australian Heritage Commission on:
- objections to listings;
- new statements of significance for places in the register;
- the appropriateness of statutory conservation advice made by staff under delegation;
- any other matter relevant to the particular environment for which the sub-committee was responsible;
- matters relating to the establishment of the new heritage system, and implementation of the amendments to the EPBC Act;
- compliance obligations under the Commonwealth Authorities and Companies Act 1997;
- administrative, financial, operating and accounting controls; and
- internal and external audit requirements.
The commission operated under its own chief executive instructions and financial delegations and had its own internal audit and evaluation programme. Fraud and risk assessment was conducted in conjunction with the Department.

During the six-month reporting period of 1 July to 31 December 2003 there were no appointments, re-appointments or retirements.
Commission meetings
Between 1 July and 31 December 2003, the Australian Heritage Commission met (Australian Heritage Commission 166) in Canberra on 12 September 2003. Attendance was Chairman Mr Harley, commissioners Temple, Chatfield, Sculthorpe, Lennon, Mills and Beale with apologies from commissioners Behenna and Saunders.
