Dear Minister

In accordance with section 63 or the Public Service Act 1999, I present the Annual Report of the Department of the Environment and Heritage for 2002-03.

This report includes the Annual Report on the Operation of the Environment Protection and Biodiversity Conservation Act 1999 which provides my report to you on the administration of the Act and a statement under section 518 (2)(a) of the Act on non-compliance with time limits. The Annual Reports on the operation of the Ozone Protection Act 1989 as required by section 68 of that Act, on the operation of the Hazardous Waste (Regulation of Exports and Imports) Act 1989 as required under section 61 of that Act and on the operation of the Protection of Movable Cultural Heritage Act 1986 as required under section 47 of that Act are also included.

For the first time this report also includes the Annual Report on the operation of the Fuel Quality Standards Act 2000 as required under section 71 of that Act and the Annual Report on the operation of the Product Stewardship (Oil) Act 2000 as required under section 35 of that Act.

On 1 July 2002, the Commonwealth Bureau of Meteorology was established as an executive agency under the Public Service Act 1999 within the Environment and Heritage portfolio and on 12 September 2002 was established as a prescribed agency under the Financial Management and Accountability Act 1997. Progress made in 2002-03 towards achieving the portfolios's outcome two - Australia benefits from meteorological and related science and services - can be found in the Bureau of Meterology's Annual Report.

The Australian Heritage Commission, Director of National Parks, Great Barrier Reef Marine Park Authority, Australian Greenhouse Office and Supervising Scientist each publish a separate annual report.

Although it is a separate statutory agency, the Office of the Renewable Energy Regulator was not a prescribed agency under the Financial Management and Accountability Act 1997 for the 2002-03 financial year. For this reason, the agency's financial statements, and information about other activities not included in the agency's annual report, are included in this report.

A summary of the performance of the Natural Heritage Trust is provided in this report. A detailed Review of performance is contained in the Natural Heritage Trust annual report, as required under section 43 of the Natural Heritage Trust of Australia Act 1997.
