The Ozone Protection and Synthetic Greenhouse Gas Management Act 1989 (the Act) controls the manufacture, import and export of a range of ozone depleting substances (ODS) and synthetic greenhouse gases (SGG) in Australia. The import, export and manufacture of these 'controlled substances', and the import and manufacture of certain products containing or designed to contain some of these substances, is prohibited in Australia unless the correct licence or exemption is held.
There are four types of licences created in the Act:
- Pre-charged equipment licences allow for the import of refrigeration and air conditioning equipment, charged with an hydrofluorocarbon (HFC) or hydrochlorofluorocarbon (HCFC) refrigerant;
- Controlled substances licences allow for the import, export or manufacture of either bulk HCFCs, methyl bromide, HFCs or perfluorocarbons (PFC);
- Essential uses licences allow for the import, export or manufacture of scheduled substances such as chlorofluorocarbons (CFC); and
- Used substances licences allow the import or export of used or recycled scheduled substances, such as HCFCs or methyl bromide.
Section 40 exemptions allow for the import or manufacture of products in contravention of Schedule 4 of the Act.
Under Regulation 4 of the Ozone Protection and Synthetic Greenhouse Gas Management Regulations 1995, the Secretary may publish on the Department's website details of all licences granted. The details are limited to the name of the licensee, the type of licence issued and the date on which it was issued.
