Cross-cutting issue 13: Liability and redress

In Australia the main body of law for liability and redress is the Environment Protection and Biodiversity Conservation Act 1999 ( EPBC Act), which protects the environment, particularly matters of national environmental significance, and streamlines national environmental assessment and approvals processes. Compliance and enforcement mechanisms include: court injunctions; environmental audits; strict civil and criminal penalties; remediation of environmental damage; liability of executive officers; and publicising contraventions. The Gene Technology Act 2000 regulates all dealings with genetically modified organisms in Australia. The scheme identifies and manages risks posed by, or as a result of, gene technology.
