Accreditation of a Plan of Management for the Purposes of Part 13
I, ANDREW MCNEE, Delegate of the Minister for the Environment and Heritage, being satisfied that:
- The management regime in force under the Western Tuna and Billfish Fishery Management Plan 2005, as amended by the Western Tuna and Billfish Fishery Management Plan Amendment 2006 (No.1),in force under the Commonwealth Fisheries Management Act 1991, requires persons engaged in fishing under the plan and amendments to the plan to take all reasonable steps to ensure that members of listed threatened species, listed migratory species, cetaceans and listed marine species are not killed or injured as a result of the fishing; and
- The fishery to which the plan and the amendments to the plan relate does not, or is not likely to, adversely affect:
- the survival or recovery in nature of any listed threatened species; or
- the conservation status of a listed migratory species, cetacean, or listed marine species or a population of that species,
hereby accredit the Western Tuna and Billfish Fishery Management Plan 2005, as amended by the Western Tuna and Billfish Fishery Management Plan Amendment 2006 (No.1),as in force at the date of this instrument, pursuant to sections 208A, 222A, 245 and 265 of the Environment Protection and Biodiversity Conservation Act 1999 for the purposes of Divisions 1, 2, 3 and 4 of Part 13 of the Act.
