Queensland Deep Water Fin Fish Fishery

Accreditation of a Plan of Management for the Purposes of Part 13
Department of the Environment and Heritage, 28 October 2005

I, ANDREW MCNEE, Assistant Secretary, Marine Environment Branch, as Delegate of the Minister for the Environment and Heritage, being satisfied that:

1. The management regime in force under the Queensland Fisheries Act 1994, the Queensland Fisheries Regulation 1995, and the Fisheries (Coral Reef Fin Fish) Management Plan 2003 for the Deep Water Fin Fish Fishery, requires persons engaged in fishing under the management regime to take all reasonable steps to ensure that members of listed threatened species, listed migratory species, cetaceans and listed marine species are not killed or injured as a result of the fishing; and
2. The fishery to which the management regime relates does not, or is not likely to, adversely affect:
   • the survival or recovery in nature of any listed threatened species; or
   • the conservation status of a listed migratory species, cetacean, or listed marine species or a population of that species,

hereby accredit the Queensland Fisheries Act 1994, the Queensland Fisheries Regulation 1995 and the Fisheries (Coral Reef Fin Fish) Management Plan 2003, to the extent that the Regulation, Act and Plan apply to the Deep Water Fin Fish Fishery, pursuant to sections 208A, 222A, 245 and 265 of the Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) for the purposes of Divisions 1, 2, 3 and 4 of Part 13 of the EPBC Act.
