Accreditation of a Plan of Management for the Purposes of Part 13
I, Mick Trimmer, Acting Assistant Secretary, Wildlife Trade and Sustainable Fisheries Branch, as Delegate of the Minister for the Environment and Heritage, being satisfied that:
- The Queensland Fisheries Regulation 1995 in force under the Queensland Fisheries Act 1994, to the extent that the Queensland Rocky Reef Fin Fish Fishery management regime is a plan of management for the Queensland Rocky Reef Fin Fish Fishery, requires persons engaged in fishing under the management regime to take all reasonable steps to ensure that members of listed threatened species, listed migratory species and cetaceans are not killed or injured as a result of the fishing; and
- The fishery to which the management regime relates does not, or is not likely to, adversely affect:
- the survival or recovery in nature of any listed threatened species; or
- the conservation status of a listed migratory species or cetacean or a population of that species,
hereby accredit the Queensland Fisheries Regulation 1995 in force under the Fisheries Management Act 1994 to the extent that the Regulations apply to the Queensland Rocky Reef Fin Fish Fishery, pursuant to sections 208A, 222A and 245 of the Environment Protection and Biodiversity Conservation Act 1999 for the purposes of Divisions 1, 2 and 3 of Part 13 of the Act.
