Accreditation of a Plan of Management for the Purposes of Part 13
I, LARA MUSGRAVE, acting Assistant Secretary, Marine Environment Branch, as Delegate of the Minister for the Environment and Heritage, being satisfied that:
- The Western Australian Marine Aquarium Fish Management Plan 1995 and the associated management regime for the fishery, in force under the Western Australian Fish Resources Management Act 1994 and Western Australian Fish Resources Management Regulations 1995, are a plan of management for the Western Australian Marine Aquarium Fish Managed Fishery, that requires persons engaged in fishing under the plan of management to take all reasonable steps to ensure that cetaceans are not killed or injured as a result of the fishing; and
- The fishery to which the plan of management relates does not, or is not likely to, adversely affect the conservation status of cetaceans or a population of those species
hereby accredit the Western Australian Marine Aquarium Fish Management Plan 1995 and the Western Australian Fish Resources Management Act 1994 and Fish Resources Management Regulations 1995, to the extent that they apply to the MAF, pursuant to s.245 of the Environment Protection and Biodiversity Conservation Act 1999 for the purposes of Divisions 2 and 3 of Part 13 of the Act.
