Accreditation of a Plan of Management for the Purposes of Part 13
I, Ian Cresswell, Delegate of the Minister for the Environment and Heritage, being satisfied that:
- the Pearling (General) Regulations 1991 and associated Ministerial Guidelines in force under the Pearling Act 1990 (Western Australia), to the extent that the Regulations and Guidelines are a plan of management for the Western Australia Pearl Oyster Fishery, requires persons engaged in fishing under the Regulations and Guidelines to take all reasonable steps to ensure that members of listed threatened species, listed migratory species, cetaceans and listed marine species are not killed or injured as a result of the fishing; and
- the Western Australian Pearl Oyster Fishery does not, or is not likely to, adversely affect:
- the survival or recovery in nature of any listed threatened species; or
- the conservation status of a listed migratory species, cetacean, or listed marine species or a population of that species,
hereby accredit the Pearling (General) Regulations 1991 and associated Ministerial Guidelines as in force at the date of this instrument, pursuant to sections 208A, 222A, 245 and 265 of the Environment Protection and Biodiversity Conservation Act 1999 for the purposes of Divisions 1, 2, 3 and 4 of Part 13 of the Act.
