The department has investigated a contravention of the Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) during a vineyard development by White Hot Industries Pty Ltd on their property along the Tasman Hwy, Falmouth, Tasmania. The contravention involved the clearing of 4 ha of foraging and potential nesting habitat critical to the survival of the endangered Swift Parrot. In response to the clearing, the Minister’s delegate issued a remediation determination under s480D of the EPBC Act on 1 October 2013.

The remediation determination requires White Hot Industries Pty Ltd to conduct revegetation works on 7.9 ha of land, and protect a further 12.2 ha of blue gum woodland to provide foraging and nesting habitat for the Swift Parrot.

White Hot Industries Pty Ltd has cooperated with departmental officers throughout the investigation and has been willing to undertake rehabilitation works on the property.
