Variation to Declaration of an Approved Wildlife Trade Operation

I, Ian Cresswell, Delegate of the Minister for the Environment and Heritage, hereby vary under subsection 303FT(7b) of the Environment Protection and Biodiversity Conservation Act 1999, the Declaration of an Approved Wildlife Trade Operation dated 3 March 2003 for the harvesting of Pecten fumatus (Commercial Scallop) and Mimachlamys asperrima (Doughboy Scallop) from the Bass Strait Central Zone Scallop Fishery under the Bass Strait Central Zone Scallop Fishery Management Plan 2002:

  1. Revoke condition a) and the Schedule:
    Has effect in relation to the regulated native specimens listed in the Schedule and subject to the conditions applied under S303FT specified in the Schedule.
  2. Revoke condition b):
    Is valid from 18 February 2003 until 30 June 2005.
  3. Include a new condition a):
    Operation of the fishery will be carried out in accordance with the Bass Strait Central Zone Scallop Fishery Management Plan 2002.
  4. Include a new condition b):
    AFMA to inform DEH of any proposed amendment to the management regime for the Bass Strait Central Zone Scallop Fishery to enable DEH to evaluate any impact on the ecological sustainability of the fishery.
  5. Include a new condition c):
    AFMA to report annually to DEH on:
    1. The extent to which the performance criteria of the Bass Strait Central Zone Scallop Fishery Management Plan 2002 were met in the year; and
    2. The progress of AFMA in implementing the recommendations for the Bass Strait Central Zone Scallop Fishery.
  6. Include a new condition d):
    This declaration expires on 21 April 2006.
