Accreditation of a plan of management and declaration pursuant to section 33

I, ANDREW MCNEE, Assistant Secretary, Marine Environment Branch, as Delegate of the Minister for the Environment and Heritage, pursuant to subsection 33(3) of the Environment Protection and Biodiversity Conservation Act 1999 (the EPBC Act), hereby accredit the Eastern Tuna and Billfish Fishery Management Plan 2005, as in force under the Commonwealth Fisheries Management Act 1991 at the date of this instrument.

Pursuant to subsection 33(1) of the EPBC Act, I hereby declare that actions taken in a Commonwealth marine area that are approved by the Australian Fisheries Management Authority in accordance with the Eastern Tuna and Billfish Fishery Management Plan 2005, do not require approval under Part 9 of the EPBC Act for the purposes of sections 23 and 24A of the EPBC Act.
