About the submission

The Department of the Environment and Water Resources (DEW) has received a submission - Submission to the Department of the Environment and Water Resources on behalf of the NSW fishing industry seeking ongoing export approval for the spanner crab component of the NSW Ocean Trap and Line Fishery from the New South Wales Department of Primary Industries in November 2007.

The purpose of the submission is to seek export approval for the spanner crab component of the New South Wales Ocean Trap and Line Fishery. The spanner crab component is currently included as part of the New South Wales Ocean Trap and Line Fishery Wildlife Trade Operation which is valid until 14 December 2007.

The report has been prepared to address the Australian Government Guidelines for the Ecologically Sustainable Management of Fisheries, 2nd Edition (the Guidelines) and to provide updates on the implementation of recommendations relevant to the spanner crab sector made in the original DEW assessment of the New South Wales Ocean Trap and Line Fishery.

The submission will be used to assess the spanner crab component of the New South Wales Ocean Trap and Line Fishery for the purposes of Parts 13 and 13A of the Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act).

Consideration will be given to:

  • declaring the spanner crab component of the New South Wales Ocean Trap and Line Fishery as managed consistent with the Fisheries Management Act 1994, Fisheries Management (General) Regulation 2002, Fisheries Management (Supporting Plan) Regulation 2006 and the Fisheries Management (Ocean Trap and Line Share Management Plan) Regulation 2006 as an Approved Wildlife Trade Operation under section 303FN of the EPBC Act; and
  • including on the list of exempt native specimens, specimens harvested in the spanner crab component of the New South Wales Ocean Trap and Line Fishery under the provisions of the Fisheries Management Act 1994, Fisheries Management (General) Regulation 2002, Fisheries Management (Supporting Plan) Regulation 2006 and the Fisheries Management (Ocean Trap and Line Share Management Plan) Regulation 2006.

In accordance with the provisions of sections 303FR and 303DC of the EPBC Act, you were invited to comment on this proposal.
