Variation to Declaration of an Approved Wildlife Trade Operation

I, Mark Flanigan, Delegate of the Minister for the Environment and Heritage, hereby vary under subsection 303FT(7b) of the Environment Protection and Biodiversity Conservation Act 1999, the Declaration of an Approved Wildlife Trade Operation dated 29 November 2004 for the harvesting of specimens that are, or are derived from, fish or invertebrates, other than specimens of species listed under Part 13 of the Act, taken in the Northern Territory Shark Fishery, as defined in arrangements set out in the Northern Territory Fisheries Regulations made under the Northern Territory Fisheries Act 1988:

  1. Revoke condition a):

Is valid until 1 June 2005.

  1. Include a new condition a):

Is valid until 31 November 2007.

  1. Revoke condition b) and the Schedule:

Is subject to the conditions applied under s.303FT specified in the Schedule.

  1. Include a new condition b) and Schedule (dated May 2005):

Is subject to the conditions applied under s.303FT specified in the May 2005 Schedule.

Declaration of the Harvest Operations of the Northern Territory Shark Fishery as an Approved Wildlife Trade Operation

Additional Provisions (s.303FT)

Relating to the harvesting of fish specimens that are, or are derived from, fish or invertebrates, other than specimens of species listed under Part 13 of the Act, taken in the Northern Territory Shark Fishery, as defined in arrangements set out in the Northern Territory Fisheries Regulations (see Part 8, Division 5- Shark Fishery) made under the Northern Territory Fisheries Act 1988.

  1. Operation of the NT Shark Fishery (NTSF) will be carried out in accordance with the Management Regime for the Northern Territory Shark Fishery.
  2. DBIRD to advise DEH of any material change to the Northern Territory Shark Fishery's (NTSF) management arrangements that could affect the criteria on which EPBC decisions are based, within 3 months of that change being made.
  3. Reports to be produced and presented to DEH annually, and to include:
    • Information sufficient to allow assessment of the progress of DBIRD in implementing the recommendations made in the assessment of the NTSF;
    • A description of the status of the fishery and catch and effort information;
    • A statement of the performance of the fishery against the objectives, performance indicators and measures once developed; and
    • Research completed relevant to the fishery.
