I, the HON MALCOLM TURNBULL MP, Minister for the Environment and Water Resources, hereby vary under subsection 303FT(7b) of the Environment Protection and Biodiversity Conservation Act 1999, (the EPBC Act) the Declaration of an Approved Wildlife Trade Operation dated 24 February 2006 for the harvesting of specimens that are, or are derived from, fish or invertebrates, other than species listed under Part 13 of the EPBC Act, taken in the Joint Authority Northern Shark Fishery, as defined in the Western Australian Fish Resources Management Regulations 1995 in force under the Western Australian Fish Resources Management Act 1994:

  1. Revoke condition a):
    Is valid until 27 February 2007.
  2. Include a new condition a):
    Is valid until 26 April 2008.
  3. Revoke condition b) and the Schedule (dated February 2006):
    Is subject to the conditions applied under s.303FT specified in the Schedule dated February 2006.
  4. Include a new condition b) and Schedule (dated February 2007):
    Is subject to the conditions applied under s.303FT specified in the Schedule dated February 2007.

Declaration of the Harvest Operations of the Joint Authority Northern Shark Fishery

Additional Provisions (s.303FT)

Relating to the harvesting of fish specimens that are, or are derived from, fish or invertebrates, other than specimens of species listed under Part 13 of the Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act), taken in the Joint Authority Northern Shark Fishery (JANSF), as defined in the Western Australian Fish Resources Management Regulations 1995 in force under the Western Australian Fish Resources Management Act 1994.

  1. Department of Fisheries, Western Australia (DFWA) to advise the Department of the Environment and Water Resources (DEW) of any material change to the Joint Authority Northern Shark Fishery's management arrangements.
  2. By 30 November 2007, DFWA to implement proposed formal management arrangements that will improve the ecological sustainability of the Joint Authority Northern Shark Fishery.
  3. DFWA to provide DEW with six monthly reporting on progress with implementing the proposed formal management arrangements and DEW's conditions and recommendations.
