About the application

The Department of the Environment, Water, Heritage and the Arts has received an application for a permit to interfere with cetaceans under Part 13, section 237 of the Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act).

This application is for a permit to undertake photo-documentation of Sperm whales (Physeter macrocephalus), Humpback whales (Megaptera novaeangliae) and Southern right whales (Eubalaena australis) off the north and south coast of New South Wales. This study is purely observational, consisting of passive underwater still and video photography that may involve making close approaches (within 100m) to whales. Potential benefits of this work include enhancing public awareness of cetaceans in Australian waters and improving current understanding of the occurrence and migratory paths of these whales, particularly for the Sperm whale.

The permit is requested to begin on 1 May 2009 and finish on 31 July 2010.

In accordance with the provisions of section 237(3b) of the EPBC Act, you are invited to comment on this proposal before COB 24 December 2008.
