About the agreement

The draft approval bilateral agreement provides for accreditation of South Australia’s processes for approval of proposed actions that would otherwise be assessed by the Australian Government for approval under the EPBC Act. Only one decision including conditions on approval is made by South Australia, accounting for South Australian matters and matters of national environmental significance.

The finalised approval bilateral agreement will include a list of South Australian processes that have been accredited by the Federal Environment Minister. These processes are known as ‘accredited processes’. No separate Australian Government referral, assessment or approval will be required for proposed actions that fall under an accredited process.

Notice of Intent

About this notice

Section 45(3) of the EPBC Act requires that the Minister, as soon as practicable after starting the process of developing a draft bilateral agreement with a State or Territory, publish a notice of intention to develop a draft bilateral agreement. The notice is published in the government Gazette, in a daily newspaper that circulates in the State or Territory and on the Department's website.

About the agreement

The bilateral agreement between the Commonwealth of Australia and South Australia relating to environmental assessment (the bilateral agreement) allows the Commonwealth Minister for the Environment to rely on specified environmental impact assessment processes of South Australia in assessing actions under the EPBC Act.
