Report a breach of the EPBC Act

The Department takes compliance with the EPBC Act seriously and investigates alleged breaches.

If you would like to discuss an EPBC Act compliance issue with the Department or have reason to believe that the EPBC Act has been, or is likely to be breached then please contact us. Contacting us directly will ensure that any queries you have are answered promptly.

When reporting information on a possible breach of the legislation you are able to remain anonymous. If you provide your contact details (which will assist us in investigating your allegation, as there may be further information that we need to ask from you) your identity will be kept completely confidential.

Examples of breaches under the EPBC Act

  • taking action without approval
  • breaching an approval condition
  • commencing an action after submitting a referral but it is not yet approved
  • failing to take action in a specific manner
  • failing to obtain or not complying with a permit

If you are proposing to undertake an action

You should contact us if you are unsure whether or not your proposed action will breach the EPBC Act. We can advise you if you need to refer your proposed action to the Department. If you do need to refer, you will need to submit a referral of proposed action form. This process will determine whether your proposed action will need a formal assessment and approval under the EPBC Act.
