About this notice

Section 45(3) of the EPBC Act requires that the Minister, as soon as practicable after starting the process of developing a draft bilateral agreement with a State or Territory, publish a notice of intention to develop a draft bilateral agreement. The notice is published in the government Gazette, in a daily newspaper that circulates in the State or Territory and on the Department's website.

About the agreement

The bilateral agreement between the Commonwealth of Australia and the State of Tasmania relating to environmental assessment (the bilateral agreement) allows the Commonwealth Minister for the Environment to rely on specified environmental impact assessment processes of the State of Tasmania in assessing actions under the EPBC Act.

Administrative Arrangements and Procedures made under clauses 11.2 and 19 of the Assessment Bilateral Agreement entered into by the Commonwealth of Australia and the State of Tasmania in accordance with section 45 of the EPBC Act

The Department and the Tasmanian Environment Protection Authority have agreed to administrative procedures to support the bilateral agreement. These procedures were signed on 18 July 2012.

These administrative procedures fulfill both governments' commitments in Clauses 11.2 and 19 of the bilateral agreement. Their implementation will ensure that the bilateral agreement is administered efficiently and cooperatively, in accordance with the separate legal requirements of each government.
